A Hunterdon County, NJ man was cleared of all charges alleged by a Mount Arlington girl who claimed she has been sexually assaulted for multiple years. His attorney, Michael Pappa, a partner with Rudnick, Addonizio, Pappa & Casazza PC, said he is pleased with the outcome of the case noting the “nightmare” for his client is finally over.
Mr. Pappa’s client, 30, was charged with forcing the plaintiff, now in her late teens, to engage in sexual acts with him between 2004 and 2007. The Hampton, NJ resident was charged with five counts of aggravated sexual assault, two counts of sexual assault and two counts of child endangerment. At the conclusion of a three week trial and two days of jury deliberation, the defendant was cleared of all nine criminal counts.
Mr. Pappa said there was reasonable doubt in the case from the very beginning and worked tirelessly to prove there were holes in the state’s case. “My job was to find holes in the state’s case and I was able to prove there was absolutely no medical or DNA evidence to support the claims against my client.”
The defendant was arrested and charged in 2011. The favorable outcome was a long time coming. “This was a very satisfying verdict in light of the seriousness of the charges. There was a lot at stake in the outcome of the trial,” Mr. Pappa added. “I was concerned that an innocent man could be convicted if the jury didn’t see or accept the holes in the state’s case. The jurors kept an open mind and decided the case on the evidence and lack of evidence.”
