If you or someone you love has been injured in a truck or other transportation-related accident in New Jersey, you need a knowledgeable lawyer to fight for your rights. This is even more true if the driver of the other vehicle was high on pot – even medical marijuana.
Medical marijuana, with a bonafide prescription from a licensed physician, is legal in New Jersey. Recreational marijuana is also legal in a few states across the country, although New Jersey is not one of them.
Regardless, truck drivers who operate vehicle under the influence of pot, whether it’s been smoked for medicinal reasons or because the trip began in a state where recreational use is legal, will be held fully responsible under New Jersey law for accidents and injuries caused here. It’s important to note, however, that there have been numerous instances of “medical marijuana defense strategies” throughout New Jersey. A savvy lawyer will argue against those defenses on your behalf.
According to an announcement made from the head of the US Department of Transportation, various state initiatives regarding marijuana usage will not affect the rules and regulations governing operators of transportation vehicles, namely trucks, buses, trains, etc.
According to the DOT’s press release, “it is important to note that marijuana remains a drug listed in Schedule I of the Controlled Substances Act. It remains unacceptable for any safety‐sensitive employee subject to drug testing under the Department of Transportation’s drug testing regulations to use marijuana.”
Indeed, the DOT will continue to maintain its Drug and Alcohol Testing Regulation (49 CFR Part 40) for all bus drivers (commercial, city and school bus), airplane pilots and aircraft maintenance workers, transit police officers, ship captains, train and subway engineers, truck drivers, and other emergency response personnel.
Similarly, New Jersey law enforcement officials will arrest and charge drivers who operate vehicles under the influence of alcohol and drugs in New Jersey.
