Eligibility for Workers’ Compensation for Home-Based Employees

October 12, 2017

As surprising as it may sound, there is actually a possibility for workers’ compensation for those who work at home. When people hear this, they often think it means that as long as they are employed from home and hurt on the job, they are automatically entitled to workers’ compensation. Unfortunately, this is untrue, and it is relatively difficult to receive workers’ compensation if working from home, but here are a few examples of situations that are eligible.

Employer Forced you to Work from Home

So, you’re working at an office for your boss, when all of a sudden your company is forced to downsize for one reason or another. They tell you that they no longer have room for an office at their location, so you are able to work from home for the majority of your work. They tell you it will be great, and you’ll be able to be a little more relaxed and in a different environment.

However, as you’re going to grab supplies for a task, you hurt yourself over something that was out of your control. For example, a stack of printer paper is kept in the garage, and your boss requests you have a report printed out. You go to grab the paper and trip over something that was not supposed to be there.

Essentially, this actually did happen to someone who won a workers’ compensation case while she was working from home. That being said, it is very difficult to win a case when working from home. You must be able to justify that you are being forced to work from home and that you were performing work functions when your injuries occurred. This case was actually rejected at first simply because she worked from home, but was later reconsidered.
